Plaintiffs’ attorneys say the New Jersey borough of Mountainside is breaking “new ground for absurd employment law defenses.” The suit they brought on behalf of five policemen and a part time female dispatcher alleges that there was sexual harassment, not to mention racist and homophobic behavior, in the police department. The accusations involve nudity and, perhaps not at the same time, something called “Big Blue” — a sex toy. But defense lawyers say the allegations, even if true, don’t add up to a legal claim, in part because the targets were of both genders.
