Kevin Brown and Diane Miller were a couple for 22 years, and had a child together. Now she wants a divorce. But two courts have told her no: since she didn’t marry him, she can’t divorce him. Miller did have opportunities to marry Brown, but whenever he asked, she declined. Therefore a Susquehanna County, Pa., court dismissed her case for divorce and alimony, and the state Superior Court upheld that decision. Even when Pennsylvania allowed common-law marriage, as it did until 2005, an oral contract was required, and Judge Carl A. Solano saw no evidence of such an agreement in this case.
