Alexis Cason, 22, was ticketed in Oviedo, Fla., after she flashed her headlights to warn other drivers of two police officers on the side of the road. But her lawyer got the ticket thrown out, and is asking for a judge to impose a ban on tickets for flashing — at least that kind of flashing. The theory: the Constitutional right to free speech is violated when police punish people for warning other drivers of their presence. The pending lawsuit alleges that officers who write these tickets engage in behavior that is “illegal, wrongful and unconstitutional,” and subjects motorists to unwarranted seizures in the form of fines.
