Convertible

Five years ago Brittany Lahm, now 24, of New York, N.Y., was driving home with four friends, all aged 19, after a day at the beach. She crashed, and since Lahm had taken her hands off the wheel, which led to the crash, she was sued by one of her injured passengers. A jury threw it out, so the passenger appealed; the appeals court has upheld the verdict, saying Lahm was not responsible. Yes, the judges note, she took her hands off the wheel, but she had suffered “a sudden and unforeseen emergency not of her own making” — passenger Brandon Berman, 19, had untied her bikini top while she was driving — “causing the top to fall.” She instinctively grabbed for it to cover up, which resulted in the accident. One of her friends died: Berman. (RC/New York Daily News) ...As usual, they sued the wrong person.
